CONTRIBUIÇÕES DA VISÃO SISTÊMICA DE MATURANA E VARELA PARA O E-JUDICIÁRIO

O presente artigo pretende analisar o sistema judicial sob a perspectiva sistêmica de Maturana e Varela. Para tanto, retrata as necessidades do Judiciário contemporâneo diante da sociedade mundial e apresenta a teoria da biologia da cognição e seus conceitos operacionais centrais. Em seguida, identifica no Judiciário a presença destes conceitos operacionais, a fim de demonstrar ser possível um olhar inovador para tratar das mudanças no sistema judicial. Trata-se de olhar o Judiciário a partir de um novo referencial e compreendê-lo como estruturalmente determinado, de forma a possibilitar ações desencadeadoras de mudanças estruturais.

contributions of Maturana and Varela's systemic perspective to the e-Judiciary

The article intends to analyze the judicial system from the systemic perspective of Maturana and Varela. To do so, it portrays the needs of the contemporary Judiciary in the world society and presents biology of cognition theory and its central operational concepts. It then identifies in the Judiciary the presence of these operational concepts in order to demonstrate an innovative approach to dealing with changes in the judicial system. It is a question of looking at the Judiciary from a new frame of reference and understanding it as structurally determined, in order to enable actions that trigger structural changes.
