PROTEÇÃO DE CRIANÇAS E ADOLESCENTES EM DESASTRES AMBIENTAIS: UMA ANÁLISE A PARTIR DOS DIREITOS HUMANOS E DA PROTEÇÃO PRIMÁRIA E INTEGRAL

O presente estudo analisa a proteção de crianças e adolescentes em contextos de desastres ambientais à luz dos direitos humanos e da teoria da proteção integral. O objetivo geral consiste em examinar de que forma a proteção primária e integral pode orientar a atuação estatal na garantia dos direitos fundamentais de crianças e adolescentes em situações de desastres ambientais. Como objetivos específicos, busca-se: (i) compreender a construção normativa dos direitos da criança e do adolescente no âmbito dos direitos humanos; (ii) identificar os impactos dos desastres ambientais na violação de direitos fundamentais desse grupo; e (iii) analisar o papel das políticas públicas e das instituições do Sistema de Garantias de Direitos na prevenção e proteção de crianças e adolescentes em tais contextos. O problema de pesquisa consiste em investigar de que maneira a aplicação dos direitos humanos e da proteção primária e integral pode contribuir para assegurar a efetiva proteção de crianças e adolescentes em cenários de desastres ambientais. A hipótese inicialmente levantada sustenta que a adoção de políticas públicas estruturadas na perspectiva da proteção integral e na prioridade absoluta prevista no ordenamento jurídico brasileiro fortalece a prevenção de violações e promove respostas institucionais mais eficazes em situações de emergência. O método de abordagem utilizado é o dedutivo, com pesquisa bibliográfica e análise de documentos normativos nacionais e internacionais relacionados à proteção da infância e aos desastres ambientais.

PROTECTION OF CHILDREN AND ADOLESCENTS IN ENVIRONMENTAL DISASTERS: AN ANALYSIS FROM THE PERSPECTIVE OF HUMAN RIGHTS AND PRIMARY AND COMPREHENSIVE PROTECTION

This study analyzes the protection of children and adolescents in the context of environmental disasters from the perspective of human rights and the theory of comprehensive protection. The general objective is to examine how primary and comprehensive protection can guide state action in ensuring the fundamental rights of children and adolescents in situations of environmental disasters. Specifically, the study seeks to: (i) understand the normative construction of children's and adolescents’ rights within the human rights framework; (ii) identify the impacts of environmental disasters on the violation of the fundamental rights of this group; and (iii) analyze the role of public policies and institutions of the Rights Guarantee System in the prevention and protection of children and adolescents in such contexts. The research problem investigates how the application of human rights and the principles of primary and comprehensive protection can contribute to ensuring the effective protection of children and adolescents in disaster scenarios. The initial hypothesis argues that the adoption of public policies structured around the perspective of comprehensive protection and the principle of absolute priority established in the Brazilian legal system strengthens the prevention of rights violations and promotes more effective institutional responses in emergency situations. The study adopts a deductive methodological approach, based on bibliographical research and the analysis of national and international normative documents related to child protection and environmental disasters.
