RESUMO: A pesquisa tem por objetivo por meio do caso Dandara dos Santos analisar como o linchamento físico de pessoas trans expõe a fragilidade da democracia brasileira e a seletividade no acesso à cidadania e aos direitos humanos. A luz das teorias de Bourdieu (2011), sobre violência, Santos (2009) ,Butler (2015) sobre transexualidade, a marginalização da população trans Facchini (2008) e Guimarães com a conceituação das formas de democracia (2010). Desse modo, ao longo do estudo se levanta a problemática: como o linchamento de Dandara dos Santos reflete a crise dos princípios democráticos e a fragilidade da cidadania e dos direitos humanos para pessoas trans no Brasil? Dessa forma, parte-se da hipótese na qual a ocorrência e a exposição pública desse crime não são apenas manifestações de violência isolada, mas sim sintomas de um processo mais profundo de desumanização e exclusão de pessoas trans do pacto democrático e das garantias fundamentais do Estado de Direito. A metodologia utilizada adotará o método indutivo; o método de procedimento socio jurídico crítico e diagnóstico. Ademais a técnica de pesquisa utilizada é a revisão bibliográfica crítica e análise documental.

LYNCHING AND DEMOCRACY IN CRISIS: THE DANDARA DOS SANTOS CASE AS A MIRROR OF THE FRAGILITY OF HUMAN RIGHTS AND CITIZENSHIP OF TRANS PEOPLE IN BRAZIL.

ABSTRACT: The research aims to analyze, through the case of Dandara dos Santos, how the virtual and physical lynching of trans people exposes the fragility of Brazilian democracy and the selectivity in access to citizenship and human rights. In light of the theories of Bourdieu (2011, p. 20) on violence, Santos (2009, p. 23) on citizenship and Butler (2015, p. 25) on transsexuality, Guimarães with the conceptualization of forms of democracy (2010, p. 105- 106). Thus, throughout the study the problem arises: how does the lynching of Dandara dos Santos reflect the crisis of democratic principles and the fragility of citizenship and human rights for trans people in Brazil? Thus, we start from the initial hypotheses that the occurrence and public exposure of this crime are not just manifestations of isolated violence, but rather symptoms of a deeper process of dehumanization and exclusion of trans people from the democratic pact and the fundamental guarantees of the Rule of Law. The methodology used will be the inductive method; the method of critical and diagnostic socio-legal procedure. In addition, the research technique used is the bibliographic review, criticism and documentary analysis. In short, the research results demonstrate how through the case elucidated above, human rights and the guarantees of the democratic state are violated.
