O debate em torno dos direitos fundamentais ocupa o placo principal no cenário do Estado constitucional de direito, a reclamar a paulatina atuação dos poderes constituídos na sua defesa e promoção. A legitimação dos próprios poderes está diretamente relacionada à prevalência dos direitos fundamentais. Nesse quadrante, o presente estudo pretende discutir sobre os canais de diálogo entre os direitos fundamentais e a construção de uma noção de interesse público afinada com essa dimensão de prevalência dos direitos fundamentais, seus limites e possibilidade. O método utilizado é o dedutivo e monográfico e a técnica de pesquisa bibliográfica.

The debate around fundamental rights occupies the main stage in the scenario of the Constitutional state of law, demanding the gradual action of the constituted powers in your defense and promotion. The legitimacy of the powers is directly related to the prevalence of fundamental rights. In this scenario, this study intends to discuss about the channels of dialogue between fundamental rights and the construction of a notion of public interest in tune with this dimension of prevalence of fundamental rights, their limits and possibility. The method and technique used are, respectively, the deductive and monographic, and the bibliographic research.
