A pesquisa em tela se debruçará sobre a análise da verdade no processo penal, com enfoque na análise do material probatório como cerne da questão, a luz das críticas e visões desenvolvidas pela filosofia do Direito. Busca-se a análise filosófica da prova sob a luz das garantias constitucionais, de maneira que o processo penal seja visto e efetivamente guiado na busca pela proteção ao devido processo legal. A metodologia utilizada nesta pesquisa é de caráter bibliográfico, por meio da análise descritiva e método dedutivo.

The truth method at the criminal proceeding according to law philosophy

This article focuses on the issue of the search for truth in criminal proceedings, focusing on the analysis of the evidentiary material at the heart of the matter, in the light of the criticisms and views developed by the philosophy of law. A critical philosophical analysis of the evidence is sought in the light of constitutional guarantees, so that the criminal process is seen and effectively guided in the search for the protection of due process of law. The methodology used in this research is bibliographic, through descriptive analysis and deductive method.
