O FECHAMENTO DA FRONTEIRA VENEZUELA-BRASIL: UMA ANÁLISE DAS AÇÕES PROPOSTAS – CONFRONTAÇÃO PROCESSUAL E A PRESERVAÇÃO DOS DIREITOS HUMANOS ANTE À DECLARAÇÃO DE NOVA YORK

No presente trabalho procura-se analisar dois processos que tramitam no STF e Justiça federal de Roraima, os quais questionam-se acerca do fechamento da fronteira Venezuela-Brasil. Nas duas demandas discute-se o fluxo migratório e questões humanitárias geradas pela situação. Há assim, uma análise material e processual das questões debatidas, a identificar um acerto dos órgãos do Judiciário nas decisões interlocutórias analisadas. Em seguida, realiza-se um confronto com a Declaração de Nova York, que mesmo não citada nas decisões, estas foram perfeitamente adequadas à postura internacional. A pesquisa é baseada na doutrinária nacional e internacional.

In present work, we are looking at two processes that are processed in STF and Roraima Federal Justice, which are questioned about the closure of the Venezuela-Brazil border. The two demands discuss the migratory flow and humanitarian issues generated by the situation. Thus, a material and procedural analysis of issues debated, identify a correctness of the organs of the Judiciary in analyzed interlocutory decisions. This is followed by a confrontation with the New York Declaration, which, even when not mentioned in decisions, was perfectly adequate for international position. The research is based on national and international doctrine.
