O DIREITO INTERNACIONAL DOS DIREITOS HUMANOS COMO TENDÊNCIA CONSTITUCIONAL PARA ALÉM DO ESTADO NACIONAL

Objetiva-se aferir em que sentido o desenvolvimento do Direito Internacional dos Direitos Humanos demonstra a existência de uma tendência constitucional no Direito Internacional. Com a adoção do método dedutivo, efetuou-se uma análise das principais doutrinas que reconhecem a possibilidade do direito internacional assumir características constitucionais, do contexto histórico que possibilitou o surgimento de tais ideias e dos avanços trazidos pelo DIDH para o estudo em enfoque. Verificou-se que o desenvolvimento do DIDH consolidou meios para se afirmar a existência de um processo de constitucionalização do direito internacional, conferindo maior legitimidade e força às normas internacionais destinadas à proteção do indivíduo.

INTERNATIONAL HUMAN RIGHTS LAW AS A CONSTITUTIONAL TENDENCY BEYOND THE NATIONAL STATE

This paper aims to verify how the development of International Human Rights Law demonstrates the existence of a constitutional tendency in International Law. With the adoption of the deductive method, an analysis of the main doctrines that recognize the possibility of international law assuming constitutional characteristics, of the historical context that allowed the emergence of such ideas and of the advances brought by the IHRL was made. It was verified that the development of the IHRL has consolidated means to affirm the existence of a process of constitutionalisation, conferring greater legitimacy and force to international norms intended to protect individuals.
