JURISDIÇÃO INDÍGENA NO NOVO CONSTITUCIONALISMO LATINO-AMERICANO: LIMITAÇÕES E DESAFIOS

A abordagem do modelo constitucional emergente na primeira década do século XXI no horizonte latino-americano revela que no seu núcleo fundamental há uma promessa de ruptura com a estrutura institucional dominante na região, caracterizada pelo monismo cultural. Avalia-se o potencial dessa ruptura desde uma análise crítica dos avanços conquistados no sentido do reconhecimento da jurisdição indígena enquanto instância legítima para solução de conflitos originados dentro das comunidades indígenas. A verificação da forma como o processo de reconhecimento ocorre revela que há uma evidente inferiorização da perspectiva cultural indígena, sobre a qual se impõe o controle da cultura ocidental dominante.

INDIGENOUS JURISDICTION IN THE NEW LATIN AMERICAN CONSTITUTIONALISM: LIMITATIONS AND CHALLENGES

The approach of the emerging constitutional model in the first decade of the 21st century on the Latin American horizon reveals that at its fundamental core there is a promise to break with the dominant institutional structure in the region, characterized by cultural monism. The potential of this rupture is evaluated from a critical analysis of the advances made towards the indigenous jurisdiction’s recognition as a legitimate instance for the conflicts originated within indigenous communities’ resolution. The verification reveals that there is an evident inferiority of the indigenous cultural perspective, over which the dominant western culture’s control is imposed.
