O RECONHECIMENTO DA PATERNIDADE OU MATERNIDADE SOCIOAFETIVA SOB A ÓTICA DO PROVIMENTO Nº 83 DO CNJ

O presente artigo cuida do reconhecimento da socioafetividade sob a ótica do Provimento 83 do (CNJ). A multiparentalidade, fundamentada no princípio da afetividade, compreende o reconhecimento fático do vínculo afetivo parental. Assim, esta pesquisa objetiva analisar as mudanças operadas pelo provimento em termos de multiparentalidade. Em relação a metodologia, será um estudo descritivo-analítico e a pesquisa operou-se do tipo bibliográfica e jurisprudencial, e quanto aos objetivos, descritiva e exploratória. Como resultado da pesquisa podemos entender que os provimentos citados vieram de forma a efetivar a não intervenção estatal e a multiparentalidade.

This article addresses the recognition of socio-affectivy from the perspective of CNJ Provision Nº 83. Multiparenting based of the principle of affectivy, comprises the factual recognition of the parental affectity bond. Thus, this research aims to analyze the changes operated by the provision in terms of multiparenting. Regarding the methodology, it will be descriptive-analytical study and the research was bibliographic and jurisprudential, and the objectives, descriptive and exploratory. As a result of a research we can understand that the aforementioned provision came in order to effect non-station intervention and multiparenting.
