Inicialmente busca-se compreender a categoria gênero, como contribui para manutenção de relações sociais baseadas em relações de poder desiguais e o lugar da violência sexual neste contexto. Posteriormente, analisa-se os casos da Corte Interamericana de Direitos Humanos (CorteIDH) dos últimos dez anos que envolvem violência sexual contra mulheres para verificar se o tribunal emprega análise a partir de perspectiva de gênero. A metodologia utilizada é teórico-bibliográfica, voltada para compreensão das questões teóricas suscitadas, e empírica, a partir da análise de casos da CorteIDH. Verifica-se que a CorteIDH tem considerado o enfoque de gênero, especialmente em casos paradigmáticos.

Initially the work seeks to understand the category gender, how it contributes to the maintenance of social relations based on unequal power relations and the place of sexual violence in this context. Subsequently, the Inter-American Court of Human Rights's (the Court) cases of the last ten years involving sexual violence against women are analyzed to verify if the Court employs gender-based analysis. The methodology used is theoretical-bibliographic, aimed at understanding the theoretical issues raised, and empirical, due to the analysis of cases of the Court. The Court is found to have considered the gender approach, especially in paradigmatic cases.
