Regras, Obrigações e Normatividade em H. L. A. Hart

O presente trabalho analisa o conceito de obrigação jurídica de H. L. A. Hart. Demonstraremos o papel central que o conceito de regras desempenha na teoria jurídica de Hart e sua relação com o conceito de obrigação. Exporemos da teoria hartiana das obrigações, mostrando qual o conceito de obrigação se adéqua melhor a ideia de uma regra e a existência do aspecto interno das regras. Por fim, mostraremos que a necessidade de séria pressão social como componente do conceito de obrigação enseja forte controvérsia e gerou, em razão das críticas, reformulação posterior na teoria proposta pelo autor.

Rules, Obligations, and Normativity in H. L. A. Hart

This paper analyzes the concept of legal obligation of H. L. A. Hart. Demonstrates the central role that the concept of rules plays in Hartian legal theory and its relationship with the concept of obligation. Presents Hartian theory of obligations, showing which concept of obligation best fits with the idea of a rule and the existence of the internal aspect of rules. Finally, shows that the need for serious social pressure as a component of the concept of obligation gives rise to strong controversy and generated, due to criticism, further reformulation in the theory proposed by Hart.
