Ante o não atendimento da proteção internacional da pessoa com deficiência previsto pela Convenção de Nova York, Tratado Internacional de Direitos Humanos, em que pese a recepção pela Carta Magna, faz-se mister seja examinada a problemática que sustenta a presente pesquisa. Procurar-se-á conduzir o presente trabalho, traçando inicialmente um percurso pelos debates que envolvem as dificuldades encontradas pelas pessoas com deficiência, ao introduzir os estudos da Teoria da Inclusão Social, apresentando em linhas gerais o panorama do modelo conceitual social de deficiência, ponto nevrálgico da cultura inclusivista.

In view of the failure to comply with the international protection of persons with disabilities provided for in the New York Convention, the International Treaty on Human Rights, in spite of the reception of the Magna Carta, it is necessary to examine the problem that underpins this research.
