O presente estudo tem como objetivo analisar os argumentos adotados pelo Supremo Tribunal Federal no julgamento do Recurso Extraordinário nº. 637.485/RJ, cujo ponto central é a interpretação do artigo 14, §5º da Constituição Federal, bem como a mudança da jurisprudência do Tribunal Superior Eleitoral acerca do tema. Após a análise dos votos do Ministros, conclui-se que estes são fundamentados, se considerados isoladamente. Entretanto, sob a visão coletiva da decisão, o julgamento apresenta um expressivo grau de “incoerência interna”, haja vista que os ministros que votaram no mesmo sentido na parte dispositiva, consideraram argumentos diversos para chegar ao resultado final.

This study aims to analyze the arguments adopted by the Federal Supreme Court in the judgment of Extraordinary Appeal no. 637,485 / RJ, whose central point is the interpretation of article 14, §5º of the Federal Constitution, as well as the change of jurisprudence of the Superior Electoral Court on the subject. After analyzing the votes of the Ministers, it is concluded that they are well founded, if considered in isolation. However, the trial has a significant degree of “internal inconsistency,” given that ministers who voted in the same vein but considered different arguments for reaching the final outcome.
