Este artigo analisa os requisitos necessários para a criação do vínculo jurídico contratual. Neste sentido, o presente trabalho apoia-se em uma pesquisa bibliográfica doutrinária. Inicialmente faz-se análise dos elementos que norteiam o direito contratual. Analisaram-se os aspectos do consenso contratual, indispensável para se aferir a existência dos contratos. Em segundo abordou-se os aspectos jurídicos quanto à validade do instrumento contratual, notadamente os vícios contratuais. Por fim, analisou-se a eficácia dos contratos, elemento indispensável para que o vínculo criado entre as partes atinja a finalidade, realizando trocas justas e uteis.

This article examines the necessary requirements for the creation of the contractual legal bond. In this sense, the present work is based on a doctrinal bibliographic research. Initially, an analysis is made of the elements that guide contract law. Aspects of contractual consensus, indispensable to assess the existence of contracts, were analyzed. Secondly, the legal aspects regarding the validity of the contractual instrument were addressed, notably the contractual defects. Finally, the effectiveness of the contracts was analyzed, an indispensable element for the bond created between the parties to achieve the purpose, making fair and useful exchanges.
