Os Direitos Econômicos, Sociais, Culturais e Ambientais a partir da perspectiva e atuação dos Sistemas Europeu e Americano de Proteção e Promoção dos Direitos Humanos

A proteção e promoção dos direitos humanos contam no direito internacional com o apoio dos sujeitos de direito internacional como protagonistas na tentativa de sua implementação. Para isso, na sociedade internacional, estruturam-se a partir de um Sistema Universal e de Sistemas Regionais de Proteção e Promoção dos Direitos Humanos. A presente pesquisa tem como objetivo central o seguinte questionamento: como os Sistemas Europeu e Americano tem atuado diante dos direitos econômicos, sociais, culturais e ambientais e, ademais, os sistemas podem ser instrumentos, a partir do diálogo construtivo, de alternativas para sua efetivação? Para desenvolver o tema, buscou-se traçar as estruturas de ambos os sistemas e o comparativo com as ações adotadas em cada região no tema dos DESCA. Por fim, conclui-se que o Sistema Europeu e o Sistema Americano tem avançado no tema e que devem e podem avançar significativamente em prol da garantia desses direitos.

Economic, Social, Cultural and Environmental Rights from the perspective and actions of the European and American Systems for the Protection and Promotion of Human Rights

The protection and promotion of human rights in international law relies on the support of international law subjects as protagonists in the attempt to implement them. To this end, international society is structured around a Universal System and Regional Systems for the Protection and Promotion of Human Rights. This research aims to address the following question: how have the European and American systems acted regarding economic, social, cultural, and environmental rights, and furthermore, can these systems, through constructive dialogue, be instruments for alternatives to their effective implementation? To develop this theme, the structures of both systems were outlined, and a comparison was made with the actions adopted in each region regarding economic, social, cultural, and environmental rights. Finally, it is concluded that the European and American systems have made progress on this issue and that they should and can advance significantly in guaranteeing these rights.
