A METODOLOGIA DA PESQUISA NO DIREITO: a análise decisória aplicada à gestão de precedentes judiciais

O presente artigo objetiva discorrer acerca dos métodos e das técnicas disponíveis para realizar-se a pesquisa e a análise científica de decisões judiciais, explicitando as principais alternativas e esclarecendo o porquê de se eleger a Metodologia de Análise Decisória (MAD) como o principal instrumento disponível para auxiliar o operador do Direito na gestão de precedentes judiciais. A metodologia eleita tem o condão de categorizar as decisões proferidas por Tribunais, por matérias e, portanto, por teses jurídicas. O procedimento adotado para produção do presente trabalho pauta-se no método jurídico-científico, com técnica de pesquisa exclusivamente bibliográfica.

LEGAL RESEARCH METODOLOGY: the decision analysis applied to legal precedents management

This scientific piece is to analyze methods and techniques available to carry out research and scientific analysis of judicial decisions, explaining the main alternatives and stating why the Decision Analysis Methodology (DAM) was chosen as the main instrument available to assist the Law operator in the management of legal precedents. The chosen methodology has the ability to categorize the decisions proffered by Courts, by matters and, therefore, by legal theses. The procedure adopted in the production of this work was based on the legal-scientific method, with an exclusively bibliographic research technique.
