OS LIMITES DO CONSTITUCIONALISMO TRANSFORMADOR: UMA ANÁLISE PSICANALÍTICA DOS EXPERIMENTOS GOLPISTAS NO BRASIL PÓS-1988

O presente artigo analisa os impasses do constitucionalismo transformador no Brasil a partir da psicanálise, mediante a adoção da teoria freudiana sobre o “instinto” ou “pulsão” de morte, enquanto categorias de análise para os experimentos golpistas pós-1988. Dessa forma, o estudo objetiva avaliar em que medida a pulsão de morte teorizada por Freud pode explicar as dificuldades do constitucionalismo transformador brasileiro no contexto após a promulgação da constituição de 1988. Para o seu desenvolvimento, a pesquisa utilizou o método dedutivo, o tipo de pesquisa explicativo – quanto à ao objetivo – e a pesquisa bibliográfica de abordagem qualitativa. Como conclusões, o trabalho verificou que a psicanálise constitui em um instrumento útil aos estudos constitucionais, à medida que é capaz de formular explicações que o direito constitucional e a ciência política, sozinhos, não podem. Portanto, o trabalho interdisciplinar, com a adoção da psicanálise, possibilita compreender a complexidade de um fenômeno que é político, constitucional e, sobretudo, humano.

THE LIMITS OF TRANSFORMATIVE CONSTITUTIONALISM: A PSYCHOANALYTIC ANALYSIS OF COUP EXPERIMENTS IN POST-1988 BRAZIL

This article explores the dilemmas and limitations of transformative constitutionalism in Brazil through the interpretive lens of psychoanalysis. Specifically, it adopts Freud’s theory of the “death instinct” or “death drive” as a conceptual framework to analyze the persistence of coup experiments that have emerged since the promulgation of the 1988 Constitution. By mobilizing this psychoanalytic category, the study seeks to evaluate the extent to which the dynamics of the death drive may account for the recurring difficulties, setbacks, and contradictions faced by Brazilian constitutionalism in its transformative aspirations. Methodologically, the research employs a deductive approach, combining an explanatory orientation with a qualitative bibliographic analysis. The findings suggest that psychoanalysis offers a distinctive and productive contribution to constitutional studies, providing interpretive possibilities that constitutional law and political science alone are unable to generate. In this sense, an interdisciplinary engagement with psychoanalysis helps illuminate the political, legal, and human complexity underlying the struggles of transformative constitutionalism in Brazil.
