AUTONOMIA ARTIFICIAL: O IMPACTO DA TECNOLOGIA PERSUASIVA NO AUTOREGRAMENTO DA VONTADE

O uso da tecnologia conduziu a sociedade a era digital, são inegáveis as comodidades e facilidades advindas da interação entre o usuário e a máquina, bem como as consequentemente mudanças nas relações sociais e em diversas searas do convívio humano que desafiam o Direito apresentar novas alternativas de pacificação social. A vontade como elemento do negócio jurídico adquire relevância quando prevista como suporte fático da norma. O uso da tecnologia persuasiva tem como objetivo mudar atitudes e comportamento dos usuários e tem como pressuposto a gerência tecnológica da vontade. Diante da perspectiva que os atos na dimensão virtual repercutem consequências materiais: qual a influência da tecnologia persuasiva na autonomia privada? Mediante a aplicação do método dedutivo, amparado na revisão jurídico-literária, o presente trabalho tem o objetivo de demonstrar que o uso da tecnologia persuasiva pode originar um negócio jurídico ilegítimo. A relevância desse trabalho é decorrente da percepção dos defeitos do negócio jurídicos que são negligenciados pelo mito da vontade livre, na verdade forjada pela exposição indiscriminada dos usuários a influência dos algoritmos.

ARTIFICIAL AUTONOMY: THE IMPACT OF PERSUASIVE TECHNOLOGY ON SELF-GOVERNANCE OF WILL

The use of technology has led society into the digital age, where the conveniences and benefits arising from the interaction between users and machines are undeniable. This has also resulted in significant changes in social relationships and various areas of human coexistence, challenging the law to present new alternatives for social pacification. The concept of will, as an element of legal transactions, becomes relevant when considered as the factual basis of the norm. The use of persuasive technology aims to change users' attitudes and behaviors, and is based on the technological management of will. Given the perspective that actions in the virtual dimension have material consequences, what is the influence of persuasive technology on private autonomy? Through the application of the deductive method, supported by a legal-literary review, this work aims to demonstrate that the use of persuasive technology can lead to an illegitimate legal transaction. The significance of this study arises from the recognition of the defects in legal transactions that are overlooked by the myth of free will, which is, in fact, forged by the indiscriminate exposure of users to the influence of algorithms.
