DIREITO AO VOTO E À DIGNIDADE: O CIDADÃO PLENO E O REFUGIADO INVISÍVEL

Este artigo reflete sobre a exclusão política decorrente da privação do voto aos imigrantes em situação de refúgio no Brasil. Com o aumento do movimento migratório é essencial repensar os critérios que determinam a cidadania e os direitos políticos e nesse sentido a proibição ao voto nas eleições evidencia uma contradição entre os ideais constitucionais e democráticos proclamados em acordos internacionais vigentes e na Constituição de 1988. O objetivo deste estudo investiga como a exclusão política está ligada à violação da dignidade humana no contexto dos refugiados no Brasil, com ênfase na privação do direito de voto. A metodologia utilizada neste estudo se fundamenta na revisão bibliográfica e documental acerca do direito constitucional, direitos humanos, democracia e imigração. Este estudo conclui que a participação eleitoral dos imigrantes em situação de refúgio tende a contribuir para o fortalecimento do Estado democrático Constitucional e de Direito estabelecido pela Constituição de 1988 ao favorecer a integração social e o reconhecimento da pluralidade cultural, ideais constitucionais necessários para promover a dignidade e a igualdade da pessoa humana.

THE RIGHT TO VOTE AND DIGNITY: THE FULL CITIZEN AND THE INVISIBLE REFUGEE

This article reflects on the political exclusion resulting from the disenfranchisement of immigrants in situations of refuge in Brazil. With the increase in migratory movement, it is essential to rethink the criteria that determine citizenship and political rights, and in this sense the ban on voting in elections highlights a contradiction between the constitutional and democratic ideals proclaimed in current international agreements and in the 1988 Constitution. The aim of this study is to investigate how political exclusion is linked to the violation of human dignity in the context of refugees in Brazil, with an emphasis on the deprivation of the right to vote. The methodology used in this study is based on a bibliographical and documentary review of constitutional law, human rights, democracy and immigration. This study concludes that the electoral participation of immigrants in situations of refuge tends to contribute to the strengthening of the democratic constitutional state established by the 1988 Constitution by favoring social integration and the recognition of cultural plurality, constitutional ideals necessary to promote the dignity and equality of the human person.
