UMA CRÍTICA À TEORIA GERAL DO DIREITO SOB O PRISMA DA FILOSFIA E DA SOCIOLOGIA JURÍDICAS

O presente trabalho tem por objetivo fazer uma introdução à reflexão acerca da filosofia do direito e da sociologia jurídica na contemporaneidade, buscando delinear o seu real papel de estudo ao assumir o direito como um fenômeno social capaz de influenciar e estruturar as relações de poder e sociais, tendo como pressuposto o direito, ou, o fenômeno jurídico como uma ciência de estudo, delimitando assim e conceituando a ciência jurídica, bem como classificando-a. Além disso, busca-se distinguir e separar os conceitos tradicionais do direito, que acabam por ser redundantes e tecnicistas, os quais, são apresentados pela teoria geral do direito, de modo que, a reflexão que se deve fazer por meio da filosofia do direito é o questionamento das estruturas sociais e de poder aos quais são impostos à sociedade, bem como, a importância do direito para se refletir acerca dos temas apresentados pela sociologia, dentre os quais, o direito assume importante papel.

A CRITIQUE TO THE GENERAL THEORY OF LAW UNDER THE PRISM OF LEGAL PHILOSPHY AND SOCIOLOGY

The present work aims to make an introduction to the reflection on the philosophy of law and legal sociology in contemporary times, seeking to delineate its real role of study in assuming law as a social phenomenon capable of influencing and structuring power and social relations. Having as a presupposition the law, or the legal phenomenon as a science of study, thus delimiting and conceptualizing the legal science, as well as classifying it. In addition, it seeks to distinguish and separate the traditional concepts of law, which turn out to be redundant and technical, which are presented by the general theory of law, so that the reflection that must be done through the philosophy of law it is the questioning of the social and power structures to which they are imposed on society, as well as the importance of law to reflect on the themes presented by sociology, among which, law plays an important role.
