As crises do setor energético ganharam maior expressão nos últimos anos, a partir do resultado de estudos que evidenciaram o dano ambiental que decorre dos processos de geração, conservação, distribuição e utilização da energia. Para além disso, a temática da segurança energética, que ganhou novos relevos com o conflito entre a Rússia e a Ucrânia, tornou ainda mais evidente as fragilidades do setor e a instabilidade no abastecimento energético de Estados que dependem do mercado de energia internacional. Nesse cenário, a sustentabilidade tem importância por ser um fenômeno em constante progresso e expansão e, quando aplicada à construção de uma matriz energética que seja sustentável, poderá conduzir processos de melhoramento contínuos. Para que isso ocorra, acredita-se que o ordenamento jurídico voltado à temática precisa ser mais permeável aos distintos contextos do sistema global. Em tal senso, considera-se que, na atualidade, o melhor instrumento jurídico-normativo para a construção da nova matriz energética global reside no âmbito do Direito Transnacional. A metodologia adotada na presente pesquisa tem natureza qualitativo-exploratória e a técnica empregada resultará de pesquisa bibliográfica.

SUSTAINABILITY AND TRANSNATIONAL LAW AS FUNDAMENTAL ASSUMPTIONS FOR THE TRANSITION OF THE GLOBAL ENERGY MATRIX

The crises in the energy sector have gained greater expression in recent years, based on the results of studies that have highlighted the environmental damage that results from the processes of generation, conservation, distribution and use of energy. In addition, the issue of energy security, which gained new relevance with the conflict between Russia and Ukraine, made even more evident the weaknesses of the sector and the instability in the energy supply of States that depend on the international energy market. In this scenario, sustainability is important because it is a phenomenon in constant progress and expansion and, when applied to the construction of an energy matrix that is sustainable, it can lead to continuous improvement processes. For this to occur, it is believed that the legal system focused on the subject needs to be more permeable to the different contexts of the global system. In this sense, it is considered that, at present, the best legal-normative instrument for the construction of the new global energy matrix lies within the scope of Transnational Law. The methodology adopted in this research has a qualitative-exploratory nature and the technique used will result from bibliographic research.
