O presente estudo propõe a analisar a audiência de custódia como medida que contenha o encarceramento em massa de presos provisórios. Apresenta-se como instrumento de suma importância no controle jurisdicional da prisão em flagrante, respeitando os direitos humanos e fundamentais do indivíduo, evitando que entrem no cárcere mesmo preenchendo os requisitos para a liberdade provisória ou outra medida cautelar. A partir da pesquisa bibliográfica e qualitativa pretende-se analisar os argumentos favoráveis e contrários a este novo instituto no sistema penal brasileiro.

The present study proposes to analyze the custody hearing as a measure that contains the mass incarceration of provisional prisoners. It is presented as an instrument of paramount importance in the judicial control of the flagrant imprisonment, respecting the human and fundamental rights of the individual avoiding as they enter jail even fulfilling the requirements for the provisional freedom or other precautionary measure. From the bibliographical and qualitative research we intend to analyze the arguments favorable and contrary to this new institute in the Brazilian penal system.
