COINCIDÊNCIAS DOS REQUISITOS PARA A DECRETAÇÃO DE PRISÃO TEMPORÁRIA E PREVENTIVA

A presente pesquisa funda-se na hipótese de coincidência de requisito para decretação de prisão temporária e preventiva, bem como o prazo da prisão temporária apresenta reflexo no prazo jurisprudencialmente fixado para prisão preventiva em havendo essa situação de coincidência. Para o mesmo faz-se uma análise do sistema processual penal, sobretudo, no que se refere as prisões cautelares, fazendo-se referência ao devido processo legal. A pesquisa faz uma análise da ineficácia do sistema das prisões provisórias hodiernamente, apontando as inconsistências das ditas prisões, sobretudo, a coexistência da prisão temporária e preventiva e o respectivo reflexos da dita coexistência.

The present research is based on the hypothesis of coincidence of a requirement for temporary and preventive detention, and how the term of the temporary arrest is reflected in the period established by law for preventive detention in case of coincidence. It is made an analysis of the criminal procedural system, mainly, about the precautionary prisons, in view of the due legal process. The research analyzes the ineffectiveness of the system of provisional prisons, and demonstrate the inconsistencies of the prisons, mainly, the coexistence of temporary and preventive prison and the respective reflections of the that coexistence.
