A função precípua do direito penal é a tutela ao bem jurídico, conforme o finalismo teleológico de Claus Roxin. Nesse sentido, é imprescindível proceder ao estudo do bem jurídico pelas normas penais. É à partir dessa relevância que se estuda a Ordem Econômica como bem jurídico tutelado pelo Direito Penal Econômico e pelo Crime de Lavagem de Dinheiro, apontando a diferenciação do conceito em ambas as vertente.

In this sense, it is essential to proceed with the study of the legal good by the criminal rules. It is from this relevance that the Economic Order is studied as a legal asset protected by Economic Criminal Law and Money Laundering Crime, pointing to the differentiation of the concept in both aspects.
