Este trabalho objetiva analisar a edição da Lei 12.654 de 2012 que inovou a Lei 12.037 de 2009 (lei da identificação criminal) ao disciplinar a criação de um banco de dados de perfis genéticos com o material coletado dos investigados e a sua compatibilidade com o direito a não autoincriminação. Utilizou-se da pesquisa bibliográfica e do método jurídico-dedutivo, partindo-se de uma perspectiva macro para uma concepção microanalítica acerca da temática ora em estudo e, por fim, como procedimento técnico a análise da questão, teórica e interpretativa.

This work aims at analyzing the edition of Law 12,654 of 2012 that innovated Law 12.037 of 2009 (Criminal Identification Law) by disciplining the creation of a database of genetic profiles with the collected material of the investigated ones and their compatibility with the right to Not self-incrimination. It was used the bibliographic research and the legal-deductive method, starting from a macro perspective for a microanalytical conception about the subject under study and, finally, as a technical procedure, the analysis of the question, theoretical and interpretative.
