TRIBUNAL DO JÚRI BRASILEIRO E SUA APROXIMAÇÃO PROGRESSIVA DO MODELO DE JÚRI INGLÊS

O presente artigo tem como objetivo discorrer sobre o Tribunal do Júri no Brasil, usando como parâmetro os sistemas historicamente mais relevantes, quais sejam, o Inglês e o Francês. Após, será feita uma análise sobre a progressiva aproximação das normas do Júri brasileiro do sistema Inglês, inclusive no projeto de lei nº 8.045/2010 do novo CPP. Por fim, será averiguado se tal aproximação se coaduna com a essência e o escopo democrático do Tribunal do Júri. A vertente metodológica adotada: jurídico-sociológica; tipo de raciocínio: indutivo; tipos metodológicos da pesquisa: histórico-jurídico, jurídico-comparativo, jurídico-propositivo e jurídico-prospectivo.

BRAZILIAN JURY COURT AND ITS PROGRESSIVE APPROXIMATION TO THE ENGLISH JURY MODEL

The current article has as its objective to discourse about the of Jury Court in Brazil, using as parameters the historically most relevant systems, namely, the English and French ones. After, an analysis will be made about the progressive approximation of the Brazilian´s Jury norms to the English system, including in the bill nº 8.045/2010 of the new CCP. Lastly, will be ascertained if such approximation is consistent with the democratic essence and scope of the Jury Court. The methodological aspects adopted: juridical-sociological; reasoning type: inductive; Research methodological types: historical-juridical, juridical-comparative, juridical-propositional, juridical-prospective.
