A INADMISSIBILIDADE DE PROVA ILÍCITA E O PROJETO DE LEI Nº 4.850/2016

O presente trabalho faz breve análise do Projeto de Lei n. 4.850, cunhado pelo Ministério Público Federal e submetido ao processo legislativo federal perante a Câmara dos Deputados sob iniciativa popular no ano de 2016. Com efeito, dentre as várias alterações legislativas que o Projeto carrega consigo, está a previsão de admissão de provas ilícitas ou obtidas por meios ilícitos, sobretudo na investigação dos crimes contra a administração pública, desde que de boa-fé. Destarte, aborda-se o instituto da regulamentação e aplicação das provas ilícitas, consistente na violação de direitos fundamentais (direitos materiais) previstos na Constituição da República.

The present work briefly analyzes Law Bill no. 4,850, coined by the Federal Public Ministry and submitted to the federal legislative process before the Chamber of Deputies under popular initiative in the year 2016. In fact, among the several legislative changes that the Project carries with it, is the provision of admission of illicit or obtained evidence By illicit means, especially in the investigation of crimes against public administration, provided that in good faith. Thus, the institute is concerned with the regulation and application of unlawful evidence, consisting in violation of fundamental rights (material rights) provided for in the Constitution.
