Este resumo expandido pretende mostrar a inexistência do bem jurídico tutelado nos crimes tipificados pela Lei 11.343 (lei dos tóxicos). Tal análise será feita a partir da concepção de bem jurídico de Claus Roxin, analisando, principalmente, os limites que tal ator atribui ao legislador infraconstitucional. Ademais, busca-se apontar a falácia do bem jurídico coletivo “saúde publica”, partindo dos conceitos discutidos pelo autor Luís Greco.

This summary expanded to show a lack of the legal good protected in the crimes typified by Law 11.343 (Toxic Law). This analysis was based on Claus Roxin's conception of criminal juridical asset, analyzing, mainly, the limits and the attribute to the infraconstitutional legislator. In adition, it seeks to point out the fallacy of the collective criminal juridical asset "public health", starting from the concepts discussed by the author Luís Greco.
