O direito se constitui enquanto ciência viva, tendo por objeto a sociedade, esta em constante transformação. Assim, é dever dos operadores do direito atentarem-se às inovações que ocorrem no chão da vida, criando novas situações jurídicas. Aqui, se busca tratar de tema já existente na jurisprudência e na doutrina brasileira: a possibilidade do uso da psicografia no processo penal. Parte-se de um estudo histórico da psicografia, da Teoria da Prova, bem como do exame grafotécnico, tornando possível o debate da legitimidade do uso das cartas psicografadas.

Law is constituted as a living science, having as its object the society, it is constantly changing. Thus, it is the duty of law-makers to heed the innovations that take place on the floor of life, creating new legal situations. Here, we seek to deal with an already existing theme in Brazilian jurisprudence and doctrine: the possibility of using psychography in criminal proceedings. It is based on a historical study of the psychographics, of the Theory of Proof, as well as of the graphical examination, making possible the debate of the legitimacy of the use of the psychographed letters.
