O Ministério Público na revisão criminal: uma análise sobre a sua legitimidade para propor a revisão do caso penal julgado

Este trabalho teve por objetivo analisar a legitimidade do Ministério Público para o ajuizamento da Revisão Criminal de acordo com o ordenamento jurídico pátrio. A partir das doutrinas já existentes que debatem o assunto, foi feito um estudo comparativo entre o Ministério Público e suas funções no Processo Penal Brasileiro, com a natureza jurídica da revisão criminal. A interpretação que irá conduzir a conclusão é a de verificar se a partir das atribuições institucionais conferidas ao Ministério Público pela Constituição Federal de 1988, poderia entender o órgão como legitimado ao procedimento de revisão do caso penal julgado.

This research aimed to analyze the legitimacy of the District Attorney to the filing of the Criminal Revision according to the Brazilian legal order. From the existing doctrines which discuss the subject, it was made a comparative study between the District Attorney and its functions in the Brazilian Criminal Procedure, the legal nature of the criminal revision. The interpretation will lead to the conclusion is to verify that from the institutional tasks of the District Attorney by the last Federal Constitution, could understand the body as legitimized the criminal case review procedure judged.
