AS ESPECIFICIDADES DA TUTELA PENAL AO BEM JURÍDICO AMBIENTAL

O presente artigo tem por finalidade ponderar até que ponto o Direito Penal deve abarcar as causas ambientais, com base na relevância do bem jurídico tutelado, ressaltando-se a forma da tutela. Discute, a partir disso, se a tutela penal, como posta, é meio indispensável e eficaz na proteção desse importante bem jurídico, que é o meio ambiente. Concluirá, ao final, pela necessidade da tutela penal ao meio ambiente, entretanto, como ultima ratio. O método de pesquisa será o teórico-jurídico com raciocínio dedutivo e técnica de pesquisa bibliográfica.

THE SPECIFICITIES OF CRIMINAL GUARANTEE FOR ENVIRONMENTAL LEGAL

This article aims to devote attention the extent to which criminal law should cover environmental causes, based on the relevance of the protected legal interest, emphasizing the form of protection. It discusses, from this, if the criminal guardianship, as placed, is indispensable and effective means in the protection of this important legal good, that is the environment. It will conclude, in the end, by the need for criminal protection of the environment, meanwhile, as ultima ratio. The research method will be the theoretical-juridical with deductive reasoning and bibliographical research technique.
