Crítica ao abuso da prisão preventiva: por uma interpretação restritiva quanto as suas hipóteses de cabimento

Este trabalho tem como objetivo analisar a complexidade das prisões cautelares e a sua aplicação no Processo Penal, verificando os requisitos que sustentam a sua decretação e eficácia nas hipóteses de garantia da ordem pública. Restou evidenciado através da análise da jurisprudência e da doutrina especializada, falhas profundas no sistema da prisão preventiva, que devem ser revistas quanto a fundamentação da medida e a sua necessidade. Observado o abuso quanto a sua aplicação, foi proposto outras medidas alternativas e uma interpretação restritiva quanto aos fundamentos da medida cautelar preventiva.

Criticism of pre-trial detention abuse: by a restrictive interpretation of its hypotheses

This study aims to analyze the complexity of the precautionary prisons and their application in the Criminal Procedure, verifying the requirements that support their decree and effectiveness in the hypotheses of guarantee of public order. It has been evidenced through jurisprudence and comentadors, deep flaws in the system of pre-trial detention, which must be reviewed as to the rationale of the measure and its necessity. In view of the abuse of its application, other alternative measures and a restrictive interpretation of the grounds for the precautionary precautionary measure were proposed.
