O presente estudo visa analisar o instituto do Tribunal do Júri sob a ótica do Estado democrático de direito, avaliando a real eficácia de suas decisões. Trata-se de uma pesquisa teórico bibliográfica, de cunho dedutivo, com vistas a verificar se os procedimentos adotados pelos julgamentos do Júri são compatíveis com o modelo constitucional de processo penal vigente no ordenamento jurídico brasileiro, sobretudo, pela dispensabilidade de fundamentação das decisões e violação dos princípios constitucionais do processo.

The present study aims to analyze the institute of the Court of the Jury from the point of view of the democratic State of law, evaluating the real effectiveness of its decisions. It is a theoretical bibliographical research, with a deductive character, in order to verify if the procedures adopted by the Jury's judgments are compatible with the constitutional model of criminal procedure in force in the Brazilian legal system, above all, by the dispensability of reasoning of decisions and violation Constitutional principles of the process.
