Esse projeto de pesquisa objetiva analisar os limites a soberania estatal frente ao jus cogens de proteção internacional da pessoa humana. O texto aborda a relação humana tendente a formar uma sociedade e, por conseguinte os Estados propriamente ditos, e da relação destes, que faz com que surja a comunidade internacional, detentora de um vínculo, constituido em razão da necessidade de coexistência pacífica dos Estados e da garantia de direitos humanos inerentes ao homem. O estudo propõe uma reflexão da natureza do jus cogens e como este limita a soberania estatal, sobretudo, na questão atinente aos direitos humanos.

LIMITS IN THE EXERCISE OF STATE SOVEREIGNTY AGAINST JUS COGENS OF INTERNATIONAL PROTECTION OF THE HUMAN PERSON

This research project aims to analyze the limits of state sovereignty against jus cogens of international protection of the human person. The text deals with the human relationship able to create a society, therefore, the States themselves, and the relationship of States, which create the international community, linked by the necessity of peaceful coexistence of States and the guarantee of human rights inherent to humans. The study proposes a reflection on the nature of jus cogens and how it limits sovereignty, mainly on the issue of human rights.
