O Direito do Trabalho vem sofrendo diversas alterações legislativas, e que tem provocado uma fragilização das relações de trabalho. A recente Lei 13.467/17 modificou diversos dispositivos da CLT, com o intuito de modernizá-la, porém, em alguns casos, provocou uma vulneração dos direitos sociais garantidos, violando o princípio da vedação ao retrocesso social. Especialmente no tocante ao trabalho da mulher gestante e lactante, permitiu-se o labor em ambiente insalubre. A novas alterações necessitam de profunda análise, principalmente à luz dos princípios constitucionais, afim de promover a tutela protetiva inerente à ordem justrabalhista.

Labor Law has undergone several legislative changes, which has caused a weakening of labor relations. The recent Law 13467/17 modified several provisions of the CLT with the intention of modernizing it, but in some cases, it provoked a violation of guaranteed social rights, violating the principle of social retrocess prohibition . Especially with regard to the work of pregnant and lactating women, work was permitted in an unhealthy environment. The new changes require in-depth analysis, especially in light of constitutional principles, in order to promote the protectionist protection inherent to the work order.
