A Escola Sem Partido à luz da Constituição de 1988: uma crítica à pretensa neutralidade da educação

O presente estudo trata dos Projetos de Lei que intentam instituir o Programa Escola Sem Partido. O objetivo principal é demonstrar que uma educação neutra, pautada exclusivamente nas convicções religiosas e morais dos pais dos alunos, na qual os alunos são compreendidos como vulneráveis e os professores como únicos sujeitos da relação educacional, cujas práticas pedagógicas precisam ser limitadas para se evitar a “doutrinação político-partidária” e a “ideologia de gênero”, nos termos das proposições legislativas analisadas, viola os princípios constitucionais relacionados com o ensino e inviabiliza a realização dos objetivos atribuídos à educação pelo texto constitucional.

The Partyless School Program in the light of the 1988 Constitution: a critique of the alleged neutrality of education

The present study addresses the project bill that aim to establish the Escola Sem Partido programme. This study’s main objective is to evidence that a neutral education, based exclusively on the students’ parents’ religious and moral beliefs, in which students are perceived as vulnerable and teachers as the sole party of the educational relationship, whose pedagogical practices need to be limited in order to avoid the “political party indoctrination” and the “queer theory”, in the terms of the analysed legislative propositions, violates the constitutional education principles and impairs the fulfilment of the goals assigned to education by the Constitution.
