Pertinência Temática e Controle de Constitucionalidade do Processo Legislativo: O Caso da ADI 4757

A Lei Complementar 140/2011 foi objeto de questionamento no Supremo Tribunal Federal na Ação Direta de Inconstitucionalidade nº 4757, protocolada em 9 de abril de 2012, pela Associação Nacional dos Servidores da Carreira de Especialista em Meio Ambiente – ASIBAMA – que ensejando discussões a respeito do processo legislativo e da matéria, visto que asseverou a instabilidade e a insegurança jurídica na implementação das competências comuns ambientais insculpidas no art. 23 da Constituição Federal. Desta feita, esta pesquisa busca demonstrar o descumprimento ao processo legislativo constitucional estabelecido pelo artigo 65 e a pertinência temática da entidade de classe retro.

Thematic Relevance and Constitutionality Control of the Legislative Process: The Case of ADI 4757

The Complementary Law 140/2011 was challenged in the Supreme Court in the Direct Action of Unconstitutionality No. 4757, filed on April 9, 2012, by the National Association of Servers of the Specialist in the Environment Career – ASIBAMA – hence discussions arose on the legislative and substantive processes, as it asserted the instability and legal uncertainty in the implementation of the common competences included in the article 23 of the Federal Constitution. This research aims to demonstrate the noncompliance with the constitutional legislative process established by article 65 of the Constitutional Charter and the thematic pertinence of this class entity.
