O presente estudo analisará a separação dos poderes e a intervenção do poder legislativo nas demais esferas, de modo a problematizar a respectiva temática a partir da analise do projeto de lei que define os crimes de abuso de autoridade. A escolha do tema se deve a sua relevância teórica e pratica no que tange ao seguinte contrapondo: O poder legislativo, usando de sua função típica (legislar), pode interferir no poder judiciário (principalmente), reduzindo sua autonomia? Esta é a pergunta problema que se pretende apresentar na presente pesquisa.

THE SEPARATION OF POWERS AND THE INTERVENTION OF LEGISLATIVE: AN ANALYSIS OF THE DRAFT LAW DEFINING THE CRIMES OF AUTHORITY ABUSE

The present study will analyze the separation of powers and the intervention of the legislature in the other spheres, in order to problematize the respective theme from the analysis of the bill that defines crimes of abuse of authority. The choice of the topic is due to its theoretical and practical relevance in relation to the following: Does legislative power, using its typical function (legislature), interfere with the judiciary (mainly), reducing its autonomy? This is the problem question that we intend to present in the present research.
