O presente trabalho aborda a liberdade de expressão em território brasileiro, desde a primeira Ordem Constitucional e sua evolução até a ‘Constituição Democrática’ de 1988, a qual estendeu e garantiu maiores liberdades à população brasileira. O objetivo do trabalho é problematizar o HC 82.424/RS de 2002, julgado por nosso Supremo Tribunal Federal, o qual abriu margens às discussões no que se refere ao tema no cenário nacional, sendo possível constatar que a liberdade de expressão é um meio de suma importância para se garantir a ordem social democrática.

Freedom of expression and hate speech in Brazil

The present research deals with the freedom of expression in Brazilian territory, from the first Constitutional Order and its evolution to the 1988 'Democratic Constitution', which extended and guaranteed greater liberties to the Brazilian population. The aim of this paper is to discuss the HC 82.424 / RS of 2002, judged By our Federal Supreme Court, which opened the way for discussions on the subject on the national scene, and it is possible to note that freedom of expression is a very important means of guaranteeing a democratic social order.
