O presente trabalho pretende demonstrar o fenômeno da mutação constitucional em virtude da luta pelos direitos civis, que no caso em análise será o problema da segregação racial nos EUA e alteração do posicionamento da Suprema Corte americana quanto aos limites da igualdade, bem como o processo de mutação legislativa e judicial no Brasil diante do julgamento da (ADPF) 186 e (ADC) 41 no STF.
