Procura-se discutir neste trabalho a reformulação dos pilares de sustentação do Estado, baseando-se na ecologização constitucional e na construção do Estado de Direito Ambiental. Aborda necessariamente o esverdeamento das normas constitucionais, bem como, o conceito de “Estado Direito Ambiental” e de “Sociedade de Risco”, além disso, busca entender a necessidade de superação do olhar jurídico meramente dogmático sobre o meio ambiente justificando a importância da concepção transdisciplinar sobre a matéria ambiental em virtude de sua dimensão no Estado Democrático de Direito. Por fim, são avaliados os desafios para concretização de um modelo estatal biocêntrico.

CONSTITUTIONAL ECOLOGIZATION AND THE RULE OF LAW ENVIRONMENTAL TO THE RISK SOCIETY.

This paper seeks to discuss the reformulation of the support pillars of the State, based on the constitutional greening and the construction of the State of Environmental Law. It necessarily addresses the greening of constitutional norms, as well as the concept of "Environmental Law State" and "Society of Risk", in addition, seeks to understand the need to overcome the merely dogmatic juridical view of the environment justifying the importance of conception transdisciplinarity on the environmental issue due to its dimension in the Democratic State of Law. Finally, the challenges for the implementation of a biocentric state model are evaluated.
