Este trabalho visa analisar se os direitos da mulher dispostos em uma Lei Orgânica são acolhidos pelos princípios explanados por John Rawls, de forma a garantir a equidade entre gêneros. Tem-se como objetivos indicar se o autor pode ser referência teórica e identificar se artigos da Lei tutelam esses direitos, conforme os princípios de justiça. Para o neocontratualista, é irrefutável o liame entre justiça social e Estado democrático de Direito, porque governantes têm o dever de representar o povo de maneira substancial. Destarte, os interesses e necessidades da sociedade são pedra angular para elaboração de legislação democrática, justa e condigna.

This paper aims to analyze if the rights of women arranged in an Lei Orgânica are accepted by the principles explained by John Rawls. Its objectives are to indicate if the author can be theoretical reference and to identify if articles of the Law protect these rights, according to the principles of justice. For the neo-contractualist, the link between social justice and democratic rule of law is irrefutable, because rulers have a duty to represent the people in a substantial way. Thus, the interests and needs of society are the cornerstone for the elaboration of democratic, just and decent legislation.
