O presente artigo pretende discutir a adoção da medida de internação compulsória dos dependentes químicos como instrumento de política sanitária a luz do sistema de direitos fundamentais estruturado pela Constituição Federal de 1988. Para tanto, busca reconstruir os argumentos a favor da reintrodução da medida de isolamento compulsório, com a finalidade de discutir a reinserção da medida (isolamento compulsório) à luz da história da profilaxia da “lepra”, cuja inadequação constitucional foi reconhecida recentemente como erro pelo Estado Brasileiro. Espera-se poder contribuir para o debate acerca da construção de políticas públicas, enquanto medidas asseguradoras dos direitos fundamentais.

The present paper aims to discuss the adoption of the compulsory segregation of drug addicts as an instrument of health policy in the light of fundamental rights system structured by the Constitution of 1988. Therefore, it seeks to rebuild the arguments for the reintroduction of compulsory confinement, in order to discuss the reintegration of the measure ( compulsory segregation ) in light of the history of leprosy prophylaxis, whose inadequacy was recently recognized as constitutional inadequate by the Brazilian State. It is expected to contribute to the discuss about the construction of public policies, while reassuring the fundamental rights.
