A busca por mecanismos alternativos de resolução de conflitos para contornar a morosidade e a ineficiência do Poder Judiciário no Brasil por conta do aumento da demanda judicial vem aumentando nos últimos tempos. O instituto da arbitragem é visto como um dos instrumentos alternativos de solução de controvérsias e sua aplicação envolvendo a Administração Pública também já é uma realidade em nosso país. Esta pesquisa buscou investigar como este mecanismo tem sido utilizado pela Administração Pública no que se refere aos contratos administrativos e a sua legalidade para a solução dos conflitos, a luz do Novo Código de Processo Civil.

The search for alternative mechanisms for resolving conflicts to circumvent the slowness and inefficiency of the Judiciary in Brazil due to the increase in judicial demand has been increasing in recent times. The arbitration institute is seen as one of the alternative instruments of dispute settlement and its application involving the Public Administration is already a reality in our country. This research sought to investigate how this mechanism has been used by the Public Administration with regard to administrative contracts and their legality for the solution of conflicts, in light of the New Code of Civil Procedure.
