A linguagem jurídica como entrave ao acesso à justiça e à implementação do Estado Democrático de Direito

Este estudo tece discussões acerca da linguagem jurídica, considerando-se esta como obstáculo ao acesso à justiça por seu caráter hermético. Ao se propor essa discussão, o que se busca é demonstrar a correspondência direta entre a relação comunicacional jurídica e o desempenho do papel do Estado enquanto pacificador dos conflitos sociais, já que a comunicação entre os “atores processuais” interfere diretamente na qualidade do serviço jurisdicional. Adotando a teoria bakhtiniana para concepção de linguagem, a semiótica e a teoria da análise do discurso, observa-se que, no âmbito jurídico, a linguagem revela múltiplas formas de conservadorismo e dominação.

The legal language as a barrier to access to justice and to the implementation of the Democratic State of Law

This study discusses the legal language, considering it as an obstacle to access to justice because of its hermetic character. What is sought by proposing this discussion is to demonstrate the direct correspondence between the legal communicational relationship and the performance of the role of the State as a peacemaker of social conflicts, since communication between the "procedural actors" directly interferes in the quality of the judicial service. Adopting the Bakhtinian theory for language conception, semiotics and discourse analysis theory, we observe that, in the legal scope, the language reveals multiple forms of conservatism and domination.
