O presente estudo científico foi elaborado através da utilização do método de pesquisa hipotético dedutivo e propõe-se a uma análise de como o instituto da mediação, enquanto instrumento de solução de conflitos, surge no direito brasileiro como uma efetiva alternativa à morosidade e ao alto custo do ingresso no Sistema Judiciário. Para tanto, aborda aspectos da mediação, trata dos conflitos familiares no Judiciário e, ainda, como a mediação é um instrumento eficaz na solução dos conflitos existentes no âmbito familiar.

The present scientific study was developed using the hypothetical deductive research method and proposes an analysis of how the mediation institute, as a conflict resolution instrument, appears in Brazilian law as an effective alternative to slowness and high cost Entry into the Judicial System. To that end, it deals with aspects of mediation, dealing with family conflicts in the Judiciary, and also how mediation is an effective instrument in resolving conflicts within the family.
