MEDIAÇÃO DE CONFLITO FAMILIAR NO DIREITO DAS FAMÍLIAS: UMA ALTERNATIVA PARA O PODER JUDICIÁRIO

O presente trabalho foi desenvolvido com o objetivo de analisar o instituto da mediação, pelo que foram estudadas as diferenças e aspectos comuns entre a mediação e outras instituições como a conciliação e a arbitragem. Para tanto, foram pesquisadas situações em que o método tradicional utilizado pelo Judiciário foi substituído pela mediação de conflitos com o fim de se aproximar da desejada ideia de justiça no direito das famílias.

The present work was developed with the purpose of analyzing the institute of mediation, so the differences and common aspects between mediation and other institutions such as conciliation and arbitration were studied. In order to do so, we investigated situations in which the traditional method used by the Judiciary was replaced by the mediation of conflicts in order to approach the desired idea of justice in family law.
