Este projeto de pesquisa objetiva analisar o dever de segurança fronteiriça dos EUA em contraposição aos direitos humanos no que se refere as ordens executivas 13769 e 13780 da Casa Branca. O texto procura abordar como se deram as ordens executivas e seus impactos na comunidade internacional, uma vez que fomentou-se um profundo debate sobre a possibilidade ou não de tais atos frente ao Jus Cogens de proteção humana. Utilizando-se do contexto histórico e uma análise sóciojurídica, o estudo propõe uma reflexão sobre os limites a proteção fronteiriça frente aos direitos humanos e a dignidade da pessoa humana.

This research project aims to analyze the US border security duty against human rights as it pertains to executive orders 13769 and 13780 of the White House. The text seeks to address how executive orders and their impacts on the international community have been given, as there has been much debate about whether or not such acts could be taken against Jus Cogens for human protection. Using the historical context and a socio-juridical analysis, the study proposes a reflection on the limits of border protection against human rights and the dignity of the human person.
