A temática desse trabalho tem como principal enfoque a dignidade da pessoa humana e a recorrente violação de tal princípio, ao qual se submetem os encarcerados do sistema penitenciário do nosso país. A pesquisa teve como método uma análise descritivo-bibliográfica, e por meio da qual visa demonstrar a união dos fatores de todo um sistema falho que reflete resultados na própria sociedade por meio de recorrentes reincidências e o aumento da violência, e o quão eficaz é uma indenização em casos de negligência a direitos fundamentais.

: The main theme of this work is the dignity of the human person. And according to with that principle, the recurrent violation to that principle to which the prisoners of the prison system of our country are subjected. The research had as a method a descriptive-bibliographic analysis, which aims to demonstrate a union of the factors of a whole flawed system that reflects results in its own society through recidivism recurrent and the increase of violence. And how much effective is a compensation in cases of negligence to fundamental rights.
