PRELÚDIO À FORMAÇÃO DE UM SISTEMA REGIONAL ASIÁTICO DE PROTEÇÃO DOS DIREITOS HUMANOS

Pretende-se no presente trabalho discorrer sobre as origens da ANSEA e como os Direitos Humanos foram inseridos em sua estrutura. Após, analisar-se-á como ocorreu a criação de sua Comissão Intergovernamental de Direitos Humanos, assim como suas funções e objetivos. Na sequência, proceder-se-á ao estudo da elaboração da Declaração de Direitos Humanos pela Comissão. Por fim, considerar-se-á a possibilidade do surgimento de um Sistema Regional Asiático de Proteção dos Direitos Humanos, a partir da Comissão e da Declaração. A vertente metodológica adotada: jurídico-dogmática; tipo de raciocínio: hipotético-dedutivo; tipos metodológicos da pesquisa: jurídico-comparativo, jurídico-propositivo e jurídico-prospectivo.

PRELUDE TO THE FORMATION OF AN ASIAN REGIONAL SYSTEM OF HUMAN RIGHTS PROTECTION

This paper intends to broach about the origins of the ASEAN and how the Human Rights were embedded in its structure. After, will be analyzed how was the creation of its Intergovernmental Commission on Human Rights, as well as its functions and objectives. Following, the study of the Human Rights Declaration´s elaboration by the Commission will be proceeded. Lastly, will be considered the possibility of an Asian Regional System of Human Rights Protection to arise from the Commission and Declaration. The methodological aspects adopted: juridical-dogmatic; reasoning type: hypothetical-deductive; Research methodological types: juridical-comparative, juridical-propositional, juridical-prospective.
